H3H3 WINS Their Lawsuit!!

  • H3H3 — the duo of Ethan and Hilla Klein — has had a difficult couple of months recently after they got sued by YouTuber Matt Hoss over a video they made reacting to his (Hoss’ video titles “Bold Guy vs. Parkour Girl”). Matt Hoss demanded they take down the video and pay him 3,750 in legal fees. The Kleins refused, not wanting to set a precedent for YouTube creators being harassed, and as a result they’ve engaged in a difficult legal process for the last year and change, which has drained them of both money and energy — and now finally, the Kleins happily announced on their YouTube channel that they have won the lawsuit presented to them by Hoss.

  • H3H3 won their lawsuit based on an interpretation of Fair Use laws — as the Kleins’ use of the video was key to producing a review of the video, and the courts called them a fantastic example of the “react” video, naming them as an example of “quintessential criticism and commentary”. H3H3 goes through the judge’s opinion in their video, but I’ll just present one of the juiciest parts, presented by H3H3’s lawyer — who was critiquing Hoss for his lawsuit attempting to curb Fair Use laws, saying —

    ”Plaintiff must realize he cannot treat well-settled law and undisputed facts like the women in his videos; they will not change simply because Plaintiff is persistent and impervious to their hostility.”
